Capybai terms of use

These terms are an agreement between you and LUCI & CO, Lucian Horvat s.p., Slovenia, [ADDRESS] ("we"). They're published at https://capybai.com/terms. By using Capybai you agree to them. Our privacy policy explains how we handle your data.

What Capybai is

Capybai is an iPhone app where an AI capybara chats with you about your money. It can read your linked bank accounts, help you build and keep one plan, answer questions and send you messages and alerts.

Not financial advice

Capybai gives general money guidance, not financial advice. It doesn't recommend specific investments, crypto, loans or credit products. It isn't a bank, a financial adviser or a debt adviser. You decide what to do with your money. If you're in financial difficulty, Capybai can point you to free debt-advice services.

The AI

Capybai's messages are written by an AI. The numbers it shows are calculated from your data, but the AI can still get things wrong or misunderstand you. Check anything important before you act on it. Capybai can't move money, buy things or change your plan without your confirmation.

Who can use it

You must be 18 or older and live in a country where Capybai is offered (the US, the UK and [TO CONFIRM: the EU countries at launch]). You need an Apple or Google account to sign in. Keep your account secure; you're responsible for what happens in it.

Linking your bank

Bank connections are provided by Plaid (US) and Tink (EU and UK). When you link a bank you also agree to their terms, shown during linking. Capybai gets read-only access: it can see balances and transactions but can't make payments. You can unlink a bank at any time in settings. EU and UK bank consents expire and need renewing from time to time.

Bank data can be late or incomplete. Capybai tells you when its numbers might be out of date.

Subscriptions

Capybai has two subscriptions, capybai and capybai + alerts, billed monthly or yearly through Apple's App Store, with a free trial for new subscribers. Apple handles payment, renewal, cancellation and refunds under its own terms. A subscription renews automatically until you cancel it in your Apple account settings at least 24 hours before the period ends. Deleting your Capybai account doesn't cancel your subscription.

What you agree not to do

• use Capybai for anything illegal
• try to break, overload or get around the app's security, limits or safety rules
• try to get the AI to produce harmful content
• send content that isn't yours to share, or that's unlawful
• access another person's account or bank data
• copy, resell or reverse-engineer the app

We may limit how much you use the chat to keep it fair for everyone.

Your content

Your messages and photos stay yours. You let us use them only to run Capybai for you, as described in the privacy policy.

Our content

The app, the Capybai character, the art and the name belong to us. You can use the app for your own personal use.

Changes and availability

We keep improving Capybai, so features can change. We may need a newer version of the app before you can keep using it. We try to keep Capybai running, but we can't promise it will always be available or error-free.

Ending

You can stop using Capybai and delete your account at any time in settings. We may suspend or close an account that breaks these terms, and we'll tell you why unless the law stops us.

Liability

Nothing in these terms limits liability that can't be limited by law, or your rights as a consumer. Otherwise, we're not liable for losses from decisions you make based on Capybai's guidance, from wrong or late bank data, or from outages of Apple, Google, Plaid, Tink or OpenAI. Law and disputes

These terms are governed by the law of Slovenia. If you live in the EU or UK, you also keep the protection of your own country's consumer laws and can bring a claim there. [TO CONFIRM: US dispute terms.]
